The article about aggressive note holders is interesting. In Florida, though, likely targets are limited to borrowers with substantial assets outside the state (i.e. lenders with homes in states with weak homestead protection.)
Of course, this new “aggressive” posture is born mostly out of desperation – second note holders have no other recourse in most cases. The value of the security is gone, so foreclosure isn’t an option that will amount to anything.
In one sense, I wonder why lenders haven’t been doing this kind of thing more often against out-of-state investors.
